By using the website www.quali-box.fr (and its national versions), you accept these Terms of Use without reservation. Please read them carefully before using the service.

1. Purpose

The purpose of these Terms of Use is to define the terms and conditions of use of the services offered by ARTIBOX SAS (publisher of the Qualibox platform) through the website www.quali-box.fr ("the Website"), as well as the rights and obligations of users.

Qualibox is a European platform for certified customer reviews, published and operated by ARTIBOX (SAS with share capital of €21,861.00, RCS Meaux 823 659 123, registered office: 36 rue de Lamirault, 77090 Collégien).

2. Definitions

• Platform: the Qualibox website, its associated interfaces and areas (public, professional, network, administration).
• User: any person accessing the Platform, whether registered or not.
• Consumer: a user who reads or submits reviews about consumer experiences.
• Professional: a business or professional registered to manage their reputation and their services.
• Review: a written account submitted by a Consumer relating to an experience with a Professional.
• Account: the secure personal area created upon registration.
• Services: all the features offered by the Platform.
• Content: any item published on the Platform (reviews, replies, images, information).

3. Services offered

Qualibox offers in particular the following services:

Browsing the directory and the reviews is free of charge for individuals. Some professional features are subject to a fee.

4. Acceptance and modification of the Terms

Use of the Website implies full and unreserved acceptance of these Terms of Use. If the User disagrees with any of the provisions, they must refrain from using the Platform.

ARTIBOX reserves the right to modify the Terms of Use at any time. Users are invited to consult them regularly. Registered users will be informed of any substantial modification by notification on the Platform or by email. The version in force is the one accessible online at the time of connection. Continued use after modification constitutes acceptance of the new Terms of Use.

5. Access to the service

Access to the Website is free and unrestricted for reading reviews, business listings and editorial content. Some features (submitting reviews, professional area, quote tracking, dashboard) are reserved for registered users or subscribers to a B2B plan.

Qualibox endeavours to ensure that the Website is available 24 hours a day, 7 days a week, but cannot guarantee the absence of interruptions (maintenance, updates, technical failures).

6. Account creation and security

Some services require the creation of an account (individual, business, network). The user undertakes to provide accurate and up-to-date information, to be a natural person of legal age with legal capacity or a duly represented legal entity, and to maintain the confidentiality of their credentials.

Any activity carried out through the account is deemed to have been performed by its holder. Each natural person or legal entity may hold only one account, unless expressly authorised otherwise. In the event of fraudulent use, the user must immediately contact contact@quali-box.fr.

7. User obligations

When using the Website, the user undertakes to:

• Comply with the laws and regulations in force
• Refrain from publishing defamatory, insulting, racist, discriminatory content or content contrary to public order
• Refrain from collecting the Website's data by automated means (scraping) without written authorisation
• Refrain from attempting to compromise the security of the Website or to access restricted areas
• Submit reviews only about professionals with whom they have had a genuine interaction
• Refrain from creating multiple accounts in order to circumvent these rules

8. Submitting reviews – Rules

Authenticity

Any review submitted on the Platform must correspond to a real and personal experience with the business concerned, be written by the person who had that experience, and sincerely reflect the opinion of its author.

Prohibited content

• Fake reviews (fictitious reviews, self-reviews, reviews written by competitors)
• Defamatory, insulting, discriminatory or hateful remarks
• Infringements of privacy (publication of third parties' personal data)
• Advertising or promotional content
• Unlawful content or content contrary to public decency
• Reviews unrelated to the business or to the experience had
• Reviews written in exchange for undisclosed consideration

By publishing a review, the user grants Qualibox a non-exclusive, worldwide, royalty-free and transferable licence to reproduce, display and distribute that review on the Website and to ecosystem partners (Thervy, ArtiBox) as part of reputation federation.

9. Moderation and certification

Reviews submitted by users are moderated before publication. Qualibox implements a process combining verification of the author's identity where possible, automated detection of suspicious content, and human moderation.

Our methodology for collecting and processing reviews is aligned with the requirements of the NF ISO 20488 standard relating to online consumer reviews.

Reviews are generally published within 72 hours of submission, after validation. Manifestly abusive reviews (defamation, personal information, spam) may be rejected or deleted.

10. Professionals' right of reply

Professionals have a right of reply to every review published on their listing. Replies must remain courteous and professional, be relevant to the review concerned, contain no defamatory remarks or personal attacks, and not disclose any personal information about the customer.

11. Intellectual property

All elements of the Website (the Qualibox trademark, logo, design, texts, graphics, databases) are protected by intellectual property law. Any reproduction without authorisation is prohibited.

Data from public sources (Sirène, etc.) remains governed by its original licences (Etalab Open Licence for French government data where applicable).

12. Liability

Qualibox cannot be held liable for:

• Direct or indirect damage resulting from the use of the Website
• Content published by users or partners
• The quality of the services performed by the listed professionals
• Disputes between users and professionals (quotes, works, lead times, payments)

ARTIBOX endeavours to ensure the availability and reliability of the Platform, but cannot guarantee the complete absence of interruption, error or data loss.

13. Personal data protection

Qualibox processes personal data in accordance with the GDPR and the French Data Protection Act ("Informatique et Libertés"). For further details, please see our privacy policy.

14. Cookies

The Website uses cookies to improve the user experience and, where applicable, to measure traffic. For further details, please see our cookie policy.

15. Termination

Qualibox may suspend or delete an account in the event of non-compliance with these Terms of Use, fraudulent behaviour or any other legitimate reason. The user may terminate their account at any time from their personal area or by written request to contact@quali-box.fr.

16. Applicable law and jurisdiction

These Terms of Use are governed by French law. In the event of a dispute, an attempt at amicable settlement will be sought before any legal action.

Failing that:

• For professionals: the courts having jurisdiction over ARTIBOX's registered office (Meaux) shall have sole jurisdiction
• For consumers: the competent courts are those provided for by the mandatory rules of the French Consumer Code (the defendant's domicile or, at the claimant's choice, the place of delivery or of performance of the service)

17. Mediation

In the event of a dispute that could not be resolved amicably, the consumer may refer the matter free of charge to a consumer mediator with a view to resolving the dispute (Article L.611-1 et seq. of the French Consumer Code).
